    What is the reasonable time to wait for the approval of I-140 (EB3, NSC) before contacting the senator's office?

    Mine has been pending for 8 months now.

    I have a couple of questions:
    1. In the AP application form, there is a question on when you intend to travel. What should I enter there when I am only applying for some future travel and am not sure about the dates?
    2. I had worked on OPT after my graduation before switching to H1 visa. So when I apply for EAD now, should I apply as a renewal applicant or a new applicant? Is OPT the same as EAD?

    Guys,
    I have a long layover at New Delhi airport. I am reaching their at 8PM and my next flight in the morning at 7:30AM. Is there any accommodation facility within airport? Or Do i need to go to city? This is the first time, i am going through delhi airport. Any helpful comments are welcome. Thanks and appreciate your help.

    The first one is definitely my fav, the only critique I have is it looks like the polarizer needed rotated so the darkened portion of sky would been horizontal instead angled.

    Our lawyer Company has decided to file the AOS application in July

    I work for a big 5 Software company & our lawyer Littler Global had taken a stand on July that they will not file our AOS application after the June VB was revoked/amended on July 2nd.

    Surprisingly , today we have received a mail from them that that keeping in view our best interest they have decided to file our AOS case in July regardless of CIS receipting them.

    Wanted to share this information as it may be helpful for you folks too ...

    I would not say that suing USCIS is of no use...It does have its own uses....

    Most of the 'American people' donot think beyond their own thing...Some donot have intellectual capacity...Some lack the curiocity..Some are stuck in mortage..marriage..lovelife...divorse...They donot have time to look at our plight or our lawsuit...


    For all 'lawsuit oriented' people ...This is some educational material...
    Some people already sued the USCIS and their attempt failed...
    Still USCIS was forced to make certain statements in a federal court and certain processing became fast because of that...

    I think if you call them then they might be able to set up the emergency appt. I got a bit frustrated by their process so I never called them.

    I have an emergency to go to India to take care of my sickly mom and I need to return back to work on July first. I am also trying to get emergency appointment. I couldnt. Could you please suggest the way I can get emergency appointment in any of the consulate.

    But dont you guys expect improvement after all this fiasco ?
    Do you not agree that INS will learn some lessons from this ?

    Since DOS does not know or INS cannot tell DOS how many apps it has waiting for approval , then how will DOS decide on the monthly cutoff for EB categories ?
    With all the fiasco. DOS will definitely ask INS and get the estimate before deciding cut off.
    INS also promised that they will work with DOS to make this cutoff process proper ?
    I dont know the details, but we may see a definite change henceforth.
    So be ready for more surprises in coming months.

    Thank You very much for your suggestion but how can he know that I am working on different project. I just want to buy a months time and then he himself will remove me from his payroll as these desi employers can't pay a single days salary on bench. Also just after a week of joining I am planning to visit India on my AP for four weeks. I want to resign after coming back. I want the initiative to be taken from his side and not mine. I have ben working with him since last five year and just for holding my H1B he has been taking a huge cut from my billing rate witout doing any thing.

    For EB2INDIA: I filed to get my EAD corrected 3 months ago...no RECEIPT NOTICE yet..


    Did you get a RECEIPT NOTICE or you directly received ur Card after 3 months w/o any receipt notice?

    They will process applications based on receipt date. But approval will happen only if your PD is current. That means if
    CASE A with PD 2003
    CASE B with PD 2005
    CASE C with PD 2007
    Say all file in July and if dates gets retrogess some time in OCT or before to 2006.
    Say for CASE A and CASE C all process is done( name check,... every thing but not approval) and CASE B is stuck in name check.
    then CASE A will be approved because A process is complete and PD is current
    CASE B will be pending waiting to clear name check though the PD is current
    Once name check done and PD is current this will approve.
    CASE C will not be approved though processing is complete PD is not current
    once PD become current CASE C will approve.


    This is just example to explain how it works.

    Did you contacted congressman or opened any SR's ?

    I've contacted the congressmen. There are 200 odd cases at NSC still lying unprocessed with earlier PD and RD (than mine) while the cutoff dates move forward for EB2-I. Are they going process all others before mine?
    With this some lucky ones will get out and other unlucky ones will complain to the congressmen. Movements without clearing up the earlier cases will cause more problems.

    ... for your help! Now, what do you guys think about getting paid until the end of June by the 1st employer (but at the same time starting to work inofficially i.e. observing only for the 2nd employer) and then going back to work for a couple of weeks for the 1st employer but staring to get paid by the 2nd so that it's fair for both? Would that be legal? If not, there really isn't a good way to deal with this since the new H1Bs are valid not before Oct (if i'd apply for 2 H1Bs), right? I obviously don't want to jeopardize my visa to make my old employer happy so don't want to do anything that's not completely OK in that regard....
    In regards to the timing of a petition for a transfer (leaving all the other stuff above aside for a moment), let's say i'd like to start at the new employer 1st of July - to be on the safe side I should get a lawyer, plan a week for them to get the petition ready and then i'd have to wait a couple weeks for the receipt notice (which then allows me to work for the new employer, correct?) - so that would make it 3 weeks?

    I called uscis and they have asked me to refile I-765. They said they will issue new EAD with extended dates. Not sure how long will it take. And i dont believe issuing 3 month EAD was intentional. They probbaly wont have any idea when the 485 would be adjudicated when they approve EAD.

    You have PD as Nov 2005, EB2.
    Now the VB is on 2006.
    They must have known atleast a month back.
    They issued just 3 months extension

    All matching perfectly and result will be good one for you....

    IV Core,

    I have chosen to participate in the Law makers meeting and received the Talking points ( no confirmed appointments yet)

    I know IV has tailored it's agenda after much thought and deliberation. However, it's my personal opinion that some points may need to be tailored based on the party affiliation of the law maker we are speaking to, as one size doesn't fit all.

    Pro-labor demands may find resonance with a Congressman of labor background, but may not sit well the pro-employer Republican. ( point 5 of IV agenda). Also Point 7 may not be liked by a Democrat as it places haves before the havenots.

    My question is can we tailor it based on whom we are speaking to or keep it standard if some points are disliked by the lawmakers?

    I haven't mentioned the actual points as I'm not sure if they can be discussed here. Is it okay to discuss it here? Or is it better discussed offline?


    Could we just keep the focus of this thread to encourage more members to send the information required to setup the meetings on Sept 17th? Your comments may be important and you may have a valid concern, but mixing all the information and individual meeting view-points is going to create a chaos.

    Here is the answer! Your filing date was July2, 07. If you filed with NSC, in Feb they had moved their processing dates to July 18th. So your case was assigned to officer for review and he called for interview!.

    Then he made a decision: Case approvable pending visa availability!

    Hope that helps!

    Yes, what Vinnysuru said makes sense completely and seems to be the apt explanation for your case. I have a question though if I may ask?
    What did the Immigration officer ask you and what were your answers? Any input from you will be appreciated by all of us if someone here gets an interview call too :)
